E. Lynn Harris: Gay Writer Passes Away

LOS ANGELES (Reuters) – E. Lynn Harris, whose best-selling novels explored the lives of black men in gay relationships, has died at age 54, his personal assistant said on Friday.

Laura Gilmore said Harris collapsed at a Los Angeles hotel on Thursday and could not be revived. Harris was on a business trip to the city from his home in Atlanta, Gilmore told Reuters.

“We don’t know what was the cause,” she said.

Harris was born in Michigan and worked as a computer salesman before taking up writing. He self-published his first book, “Invisible Life,” in 1991.

After struggling with his sexuality he became one of the pioneers of gay, black fiction. He wrote 11 books, many of them best sellers including “A Love of My Own,” “Abide With Me” and the memoir “What Becomes of the Brokenhearted.”

His most recent novel, “Basketball Jones,” was published in January. Gilmore said he had another book set for release in October.

“His pioneering novels and powerful memoir about the black gay experience touched and inspired millions of lives, and he was a gifted storyteller whose books brought delight and encouragement to readers everywhere,” Alison Rich, publicity director at publisher Doubleday, said in a statement.

A Nice Day for a Gay Wedding.

OMG — –

I can’t even begin to tell you how long ago this was, but Ben and Keith just posted these pics on Facebook.com and I had to post them here as well.  It was my first gay wedding and I was actually IN the wedding party.

I remember it very well – and the HUGE KICK ASS Party afterwards!  Friends and family abounded, drinking and dancing!  What a great thing to remember and share!  Just think of all those places that gay marriage isn’t allowed and how much the economy could be stimulated…. just a thought… just.

Prop. 8 Challenge Filed in Federal Court

In a bold move that takes a new approach to achieving marriage equality, two attorneys who argued opposing sides of the 2000 Bush v. Gore lawsuit before the U.S. Supreme Court have filed a challenge to Proposition 8 in federal court, The Advocate has learned.

Theodore B. Olson, the U.S. solicitor general from 2001 to 2004 under President George W. Bush, and David Boies, a high-profile trial lawyer who argued on behalf of former vice president Al Gore, filed the suit May 22 in U.S. district court on behalf of two California gay couples.

The attorneys argue that relegating same-sex couples to domestic partnerships instead of granting them full marriage rights is a violation of the equal protection and due process clauses of the Fourteenth Amendment to the U.S. Constitution.

Olson said he was contacted several months ago by representatives of an association called the American Foundation for Equal Rights about his willingness to represent the two couples named in the suit.

“For a long time I’ve personally felt that we are doing a grave injustice for people throughout this country by denying equality to gay and lesbian individuals,” Olson said in an interview with The Advocate. “The individuals that we represent and will be representing in this case feel they’re being denied their rights. And they’re entitled to have a court vindicate those rights.”

When pressed about his service with the Bush administration, which in 2004 endorsed an amendment to the U.S. constitution that would prohibit same-sex marriage, Olson said he was personally against the amendment at the time, though he made no public statements on the matter.

As for the timing of the suit, Olson said that recent decisions by the U.S. Supreme Court “make it clear that individuals are entitled to be treated equally under the Constitution. I’m reasonably confident that this is the right time for these [injustices] to be vindicated.”

Olson, Boies, and other attorneys working on the suit are being compensated by the American Foundation for Equal Rights, Olson said his law firm and others also are contributing resources pro bono. As of press time, no website could be found for the newly formed organization. Olson and his representatives declined to specify who was funding the campaign.

The plaintiffs in the suit are Kristin Perry and Sandra Stier of Berkeley, Calif., and Paul Katami and Jeffrey Zarrillo of Burbank, Calif. Perry is executive director of First 5 California, a state health and education agency.

A pair of law professors from Pepperdine University offered a unique solution to the marriage equality debate raging in California and other states…end marriage all together. Or to be more precise, end the role that government plays in marriage.

In an editorial published in the San Francisco Chronicle, Douglas W. Kmiec and Shelley Ross Saxer argue that all couples, gay and straight, could be issued the same license by the state. This license would carry the name “civil union” or some other name the state chooses, something other than the word “marriage”. Each couple could then get their union blessed by whatever religion they wanted, in whatever way they wanted. Equal rights would be granted to all licensed unions, while the religious sanctity of traditional marriage would remain.

The idea surfaced at recent oral arguments before the California Supreme Court when Justice Ming Chin asked each set of attorneys if such a solution would truly resolve the legal issues connected to gay marriage. Both sides, even Kenneth Starr who argued for Prop 8, agreed it would settle the issue of equal protection under the law. The opposition, attorney Michael Maroko added, “If you’re in the marriage business, do it equally. And if you’re not going to do it equally, get out of the business.”

The professors also pointed to the fact that all other precious religious milestones steeped in centuries of tradition, such as baptisms, occur without any involvement by the government. One outstanding question is how would the gay community react to a solution that removes the option of “marriage” from the table.
